1. Scope of Application
These Terms of Use (“Terms”) apply to all contracts and services provided by Finqube GmbH (“Finqube”, “we”, “us”) to users of the Finqube platform at finqube.io (“Platform”, “Services”).
Conflicting terms of the user shall not apply unless Finqube has expressly agreed in writing.
These Terms apply to both consumers and business users.
2. Subject of the Agreement
Finqube provides digital services including:
portfolio tracking
performance analysis
financial data visualization
market and company data
screening & analytics tools
The available functionality depends on the selected plan:
Free Plan
Basic Plan
Pro Plan
Finqube is not a bank, financial advisor, investment firm or licensed financial service provider. Finqube does not provide investment advice, investment brokerage, portfolio management or investment recommendations.
3. Platform Language
The Finqube platform is currently provided in English only, including but not limited to the user interface, navigation, notifications, feature descriptions and analytical outputs.
By entering into this agreement, the user expressly agrees that the use of the platform and all functionalities is provided solely in English.
Contractual documents (Terms of Use, Privacy Policy, Withdrawal Policy) may be provided in German or English. This does not affect the service language of the platform.
4. Formation of Contract
A contract for the use of paid services is concluded upon:
registration of a user account
submission of payment information
explicit confirmation of the selected paid plan
All paid plans begin with a 14-day free trial.
No payment is charged during the free trial period.
5. Free Trial (14 Days)
The free trial begins upon conclusion of the contract and entry of valid payment information.
During the free trial, the user has full access to all features of the selected paid plan.
Users may cancel or withdraw from the contract at any time during the trial period at no cost.
If the user cancels during the trial period, access to premium features continues until the end of the 14-day period. After the trial ends, the account is automatically downgraded to the Free Plan.
If the user does not cancel, the paid subscription automatically activates after the 14-day period and the respective amount will be billed.
6. Payment Processing
Payments are processed via Stripe, including integrated PayPal payment options offered through Stripe.
The terms and privacy policies of the respective payment provider apply.
Subscription fees are charged monthly or annually in advance.
If payment fails, Finqube may restrict access to premium features until payment is completed.
7. Term and Termination
Paid subscriptions remain active until cancelled.
Users may cancel their subscription at any time with effect at the end of the current billing period.
Cancellations can be made directly within the user account.
After cancellation, the account is automatically downgraded to the Free Plan.
The statutory right of withdrawal remains unaffected.
8. User Rights
Finqube grants users a non-exclusive, non-transferable right to use the platform.
Sharing accounts, credentials or unauthorized access by third parties is prohibited.
Automated bots, scraping tools or any manipulation of platform data without written consent is prohibited.
9. User Obligations
Users must keep their login credentials secure.
Users may not store or distribute illegal content via the platform.
Users are responsible for the accuracy of their own portfolio entries and transaction data.
10. Data Sources and Market Data
Finqube aggregates data from third-party providers, exchanges and APIs.
Finqube provides no guarantee for the correctness, completeness or timeliness of any financial data.
Data may be incorrect, incomplete, delayed, or temporarily unavailable.
Finqube assumes no liability for damages arising from incorrect or missing data.
11. Liability
Finqube is liable only for intent or gross negligence.
For simple negligence, Finqube is only liable for breach of essential contractual obligations, limited to foreseeable damages.
Finqube is not liable for:
financial losses arising from investment decisions
errors in market data or analysis
results of backtesting or simulations
indirect or consequential damages
Finqube provides no investment advice; all decisions are made at the user’s own risk.
12. Availability
Finqube aims to provide high availability but cannot guarantee uninterrupted service.
Maintenance work, technical issues or outages at third-party providers may affect the platform.
There is no entitlement to a specific level of availability.
13. Changes to Services
Finqube may reasonably adjust or modify features as long as users are not unreasonably disadvantaged.
14. Changes to These Terms
Finqube may amend these Terms for valid reasons (law changes, technical adjustments).
Users will be informed in advance.
Continued use after notification constitutes acceptance.
15. Governing Law and Jurisdiction
German law applies unless mandatory consumer protection laws dictate otherwise.
Place of jurisdiction for business users is Berlin, Germany.
If any provision of this agreement is or becomes invalid, the validity of the remaining provisions shall not be affected.
